Terms of service

Draft

This is a starting draft written to cover how the service actually works. It has not been reviewed by a lawyer. Have it reviewed before you run paid traffic or take payments.

01 — The agreement

These terms apply when you book an audit or use the Kryon missed-call text-back service. Using the service means you accept them. If you are agreeing on behalf of a business, you confirm you are allowed to.

02 — What we provide

We provide a phone line that forwards calls to a number you nominate. When a call goes unanswered, we send an automatic text message to the caller on your behalf and pass their reply on to you.

The service depends on mobile networks and on our telephony provider. We aim for messages to send within seconds, but we cannot guarantee delivery of any individual call or message, and we do not promise the service will be available without interruption.

03 — The free audit

The audit runs for seven days and costs nothing. It carries no obligation to continue, and we will not charge you at the end of it without you choosing to sign up. You can stop the audit at any point by telling us.

04 — What it costs

The service is $50 per month in Australian dollars, charged monthly in advance from the day you sign up. There is no setup fee and no minimum term.

We will give you at least thirty days' notice before changing the price. Fair-use limits may apply to unusually high message volumes, and we will talk to you before doing anything about it.

05 — Ending it

You can cancel at any time and the service runs to the end of the month you have paid for. We do not refund part-months. We can end the service with thirty days' notice, or immediately if it is being used unlawfully or to send unsolicited marketing.

06 — How you use it

You agree not to use the service to:

  • Send marketing messages to people who have not contacted you
  • Send anything unlawful, misleading or abusive
  • Impersonate another business

Messages sent through your line go out in your business's name, and you are responsible for their content. Australian spam and telemarketing law applies to them.

07 — Your number

The phone number we provide stays with us. If you cancel, we will do what we reasonably can to help you port it to another provider, subject to the rules that apply to number porting.

08 — Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. Beyond those rights, our liability to you is limited to the fees you paid us in the twelve months before the claim, and we are not liable for lost work, lost profit or lost business opportunity.

09 — Governing law

These terms are governed by the law of Victoria, Australia. Questions go to simon@kryon.au.
